Delivery and Return Schedule and Location

The delivery and return schedule, as well as the location of the vessel, will be determined by the lessor prior to the rental, based on operational needs and capabilities at the port.

The lessee must arrive at the delivery point at least 30 minutes in advance to receive the necessary information regarding the use of the vessel, safety instructions, an inspection, and to sign the required documentation before departure.

In case of a delay by the lessee at the time of delivery, immediate departure is not guaranteed. Other scheduled rentals may take precedence, and the departure may be postponed until all prior scheduled deliveries have been completed. In such cases, the lessee will not be entitled to financial compensation or an extension of the return time.

A delay in returning the vessel will result in the forfeiture of the security deposit.

Navigation Route

The navigation route, its area, and the distance from/to the home port will be determined by the lessor on the day of the rental, depending on weather conditions and current regulations.

Failure by the lessee to adhere to the designated route, navigation area, and distances established by the lessor will not only pose a safety risk but will also result in the forfeiture of the security deposit.

Prices

Prices include VAT, vessel insurance, and passenger insurance.

Unless otherwise agreed, fuel costs are not included. The vessel will be delivered with a full tank, and the lessee must return it in the same condition. Otherwise, the lessor will deduct from the security deposit the cost of the consumed fuel plus a refueling service fee.

Applicable refueling cost: Current rate on the rental day at the Ciutadella port service station. Refueling service fee: 30 EUR (VAT included).

Security Deposit

A security deposit of 400 EUR is required, payable in cash or by credit card at the time of vessel delivery. The deposit will be refunded after the vessel’s return and a proper inspection of its condition and equipment.

The lessee is responsible for damages not covered by the insurance policy and for any third-party claims arising from improper use of the vessel.

Qualifications

The lessee must provide proof of the necessary certification required to operate the vessel or designate a captain with the appropriate certification. In any case, the lessor will remain ultimately responsible for the use of the vessel and its occupants.

If the lessee fails to present the required certification at the time of delivery, the rental contract will be terminated, and 100% of the rental payment will be forfeited.

Exceeding the maximum allowed number of passengers and/or total weight capacity for the rented vessel is strictly prohibited.

Regulations

Compliance with navigation rules established by the Marine Command is mandatory, including adhering to speed limits of 3 knots in ports, beaches, and coves.

It is prohibited to navigate within 100 meters of the coastline or further than 500 meters from the shore.

Swimmer-designated areas must be respected, and a safe distance must be maintained from vessels displaying a diver’s flag.

Towing people or objects, fishing, and anchoring in rocky areas or on Posidonia seagrass are not allowed.

Menorca is a Biosphere Reserve; therefore, dumping any waste into the sea is strictly forbidden.

The vessel is equipped with the safety elements required by current regulations.

Personal Belongings

The lessor assumes no responsibility for any damages or losses of personal belongings left, stored, or forgotten by the lessee or any other person on the vessel, during or after the rental period.

The lessee assumes all risks associated with such losses and releases the lessor from any claims. The lessee also agrees to indemnify the lessor against any claims arising from delays due to vessel malfunction or unforeseen weather changes once the vessel has set sail.

If the vessel is unable to return to port under its own power due to mechanical failure and requires assistance, the client may claim up to a maximum of 50% of the rental payment, depending on the circumstances. If the cause of the delay is weather-related or due to other external factors beyond the company’s control, no refunds will be granted.

Cancellations

The lessor may cancel the rental due to force majeure, port operational incapacity, vessel unavailability due to maintenance or breakdown, or safety concerns for navigation. In such cases, the lessee will be offered an alternative rental day or a full refund of the reservation amount if rescheduling is not possible.

Both the lessor and lessee may request cancellation due to severe weather conditions. Only cancellations based on a forecast of all-day rain, wind exceeding force 4 on the Beaufort scale, and/or waves over 1 meter will be considered valid. Cloudy skies alone will not be a valid reason for cancellation. In such cases, the lessee will be offered an alternative rental day or a full refund if rescheduling is not possible.

If an accidental breakdown occurs during navigation, the lessee may request a refund of up to 50% of the rental payment. If the breakdown is due to the lessee’s misuse, such as improper handling of the engine or hull, the lessee will be responsible for repair costs even if they exceed the security deposit amount.

The lessee may cancel the rental for personal reasons by submitting a request to [email protected]. The lessor will refund:

• 75% of the reservation amount if canceled 30 days before departure.

• 50% if canceled between 30 and 15 days before departure.

• 25% if canceled less than 15 days before departure.

• No refund will be provided if canceled the day before or on the day of departure.

Vessel Use

The vessel is equipped with a GPS system that records real-time location, stops, distance traveled, speed, and other usage details.

Improper use or failure to follow the lessor’s instructions will result in the forfeiture of the security deposit. In case of damage to the vessel or engine, all repair costs will be borne by the lessee.

The rental is exclusively for recreational purposes. Any commercial activity is strictly prohibited. The consumption of drugs or illegal substances is not allowed.

Operating the vessel under the influence of alcohol is strictly prohibited.

Failure to comply with any clause of this contract will result in the forfeiture of the security deposit. If the deposit is insufficient, the lessor may claim additional compensation from the lessee for any damages or losses incurred.

Data Protection (LOPD Compliance)

In compliance with the Organic Law on Personal Data Protection (LOPD), we inform you explicitly, precisely, and unequivocally that the personal data you provide, as well as those generated during your relationship with our entity, will be processed in files under the responsibility of Tomás Ramón Jaimez Felguera for the purpose of maintaining and fulfilling the contractual relationship and providing related services, including communication within this framework.

Furthermore, Tomás Ramón Jaimez Felguera informs you that your data will be shared only when necessary for fulfilling the contract, controlling its compliance, or in cases authorized by law. In accordance with the LOPD and Royal Decree 1720/2007 of December 21, which approves its development regulations, you may exercise your rights of access, rectification, cancellation, and opposition at any time by contacting Tomás Ramón Jaimez Felguera and providing a copy of your ID.
