General Booking Terms and Conditions

The present General Booking Terms and Conditions (hereinafter, General Conditions) will regulate the commercial relationship that arises between Deportes de Aventura Menorca S.L. and the user or client for bookings made through the forms provided by Deportes de Aventura Menorca S.L. on its website https://www.sportskayak.es.

Booking through the websites of Deportes de Aventura Menorca S.L. implies the explicit acceptance, by the client or user of the pages, of these conditions, as well as the terms of use established for user navigation on the pages owned by Deportes de Aventura Menorca S.L.

These conditions will apply without prejudice to the application of the legal norms that may be applicable in each case.

The General Contracting Conditions regulate the remote sales relationship between Deportes de Aventura Menorca S.L. and the user or client, in accordance with legal stipulations, especially Law 7/1998, of April 13, on General Contracting Conditions, Law 3/2014, of March 27, amending the revised text of the General Law for the Protection of Consumers and Users, Organic Law 15/1999, of December 13, on the Protection of Personal Data, Law 7/1996, of January 15, on the Regulation of Retail Trade, and Law 34/2002, of July 11, on Information Society Services and Electronic Commerce.

Deportes de Aventura Menorca S.L. reserves the right to make any modifications it deems appropriate, without prior notice, to the General Conditions. Such modifications may be made through its websites by any legally admissible means and shall be binding as long as they are published on the website and until validly modified by subsequent ones. However, Deportes de Aventura Menorca S.L. reserves the right to apply, in certain cases, Specific Contracting Conditions in preference to these General Conditions when deemed appropriate, announcing them in due time and manner.

Pre-booking Information

Deportes de Aventura Menorca S.L. informs that the booking procedure through its web pages is detailed in the corresponding section for booking formalization.

Likewise, Deportes de Aventura Menorca S.L. informs that the user may access the terms of use available on the same website.

By booking with Deportes de Aventura Menorca S.L. through its website, the user or client explicitly declares to be aware of, understand, and accept these terms of use and the General Conditions. Likewise, the user declares to be of legal age and have the necessary legal capacity to access the websites of Deportes de Aventura Menorca S.L. and contract through them. The user is responsible for keeping confidential and responsibly handling the identity and password obtained during client registration, not being able to transfer them to another person.

Once the booking is made, the user will see the booking confirmation on the screen, which can be printed as proof of the booking made.

The booking confirmation and the booking receipt (user printout) will not be valid as an invoice.

In compliance with current regulations, and in particular Law 34/2002 on Information Society Services and Electronic Commerce, Deportes de Aventura Menorca S.L. offers information on all possible bookings, their characteristics, and prices in the corresponding section for booking formalization. However, Deportes de Aventura Menorca S.L. reserves the right to withdraw, replace, or change the offers available to its clients through its website, by simply modifying the content thereof. In this way, the products and/or services offered at any time by the website of Deportes de Aventura Menorca S.L. will be governed by the General Conditions in force at each moment. Likewise, the company has the power to discontinue, without prior notice and at any time, access to the mentioned products and/or services.

Price Indication

Each possible booking offered will indicate its price and whether VAT or any other applicable tax is included. The prices displayed on-screen will be the prices in force at that moment unless there is a typographical error. If the price differs due to the aforementioned reason, Deportes de Aventura Menorca S.L. will inform the client via email before proceeding with the booking charge.

Availability

The availability of offers provided by Deportes de Aventura Menorca S.L. through its website may vary depending on customer demand. Although Deportes de Aventura Menorca S.L. updates its database periodically, the requested booking may be fully booked at that moment. In such a case, Deportes de Aventura Menorca S.L. will send an email to the client informing them of the unavailability of the offer.

Payment Methods

Deportes de Aventura Menorca S.L. requires credit card details for reservations made through its website to guarantee the booking’s validity. The establishment will charge the amount to the credit card at the time of booking. The establishment reserves the right to verify the validity of the credit card. Booking Cancellation

• For guided activities (excursions): If the cancellation is made more than 24 hours in advance, no charges will be applied, and the amount may be refunded or the booking date modified. If canceled within less than 24 hours, the establishment reserves the right to charge the deposit amount.

• For motorboat rentals: If the cancellation is made more than 48 hours in advance, no charges will be applied, and the amount may be refunded or the booking date modified. If canceled within less than 48 hours, the establishment reserves the right to charge the deposit amount. If the client cancels their boat trip for reasons unrelated to the company, the company reserves the right to charge the deposit amount.

• For kayak expedition rentals: If the cancellation is made more than 15 days in advance, no charges will be applied, and the amount may be refunded or the booking date modified. If canceled between 15 and 7 days in advance, 50% of the deposit will be charged. If canceled within less than 7 days, the establishment reserves the right to charge the deposit amount.

Right of Withdrawal

According to Article 103 of Law 3/2014, of March 27, amending the revised text of the General Law for the Protection of Consumers and Users, the supply of services or goods made to consumer specifications or clearly personalized, or which by their nature cannot be returned or are likely to deteriorate or expire rapidly, are exempt from withdrawal.

Data Protection

In compliance with current regulations on Personal Data Protection, we inform you that your data will be incorporated into the processing system owned by Deportes de Aventura Menorca S.L. with tax ID B-06784797 and registered office at Mª LLUISA SERRA 85 – 3º-1ª 07703 MAÓ (ILLES BALEARS), for the purpose of facilitating, expediting, and fulfilling the commitments established between both parties.

Applicable Legislation and Jurisdiction

Deportes de Aventura Menorca S.L. reserves the right to take any civil or criminal actions it deems appropriate for improper use of its website and content or for non-compliance with these conditions.

The relationship between the user and the provider shall be governed by the applicable laws in Spain. Any dispute arising shall be subject to arbitration or to the ordinary courts in accordance with jurisdictional and competency regulations.
